Terms & Conditions of Sale, Shipping, and Fulfillment

By placing an order with Food By The Word LLC, the customer (“Customer”) agrees to the following Terms & Conditions. These terms are designed to ensure transparency, operational efficiency, and fair accountability across order fulfillment, shipping, and customer service.

1. Order Placement & Acceptance
• All orders are subject to acceptance and availability.
• Once an order is placed, Food By The Word LLC will contact the Customer to confirm delivery timing and fulfillment status.
• Orders are processed strictly on a first-in, first-out (FIFO) basis to maintain fairness and operational integrity.
• Food By The Word LLC reserves the right to delay, adjust, or cancel orders due to inventory constraints, supplier delays, force majeure events, or carrier disruptions.

2. Order Processing & Delivery Timeframes
• Standard fulfillment timeframe is 10–14 business days from order confirmation.
• In certain circumstances—including high order volume, carrier disruptions, holidays, or external logistics constraints—delivery may extend up to 14 business days.
• Business days are defined as Monday through Friday, excluding federal holidays.
• Delivery timelines are estimates, not guarantees.

Once an order has shipped, Food By The Word LLC is no longer responsible for carrier transit times.

3. Shipping & Handling
• Shipping and handling charges apply to all orders and are calculated at checkout or invoiced separately.
• Food By The Word LLC utilizes third-party carriers (e.g., USPS, UPS, FedEx).
• We are not responsible for delays, misrouting, or service failures caused by shipping carriers once the order has left our facility.
• Tracking information will be provided when available.

4. Risk of Loss & Carrier Responsibility
• Title and risk of loss pass to the Customer upon handoff to the shipping carrier.
• If a shipment is delayed, lost, or damaged in transit: 
• Food By The Word LLC will assist with carrier claims as a courtesy, not as an admission of liability.
• Carrier investigations and resolutions are outside our direct control and may require extended timelines.
• Claims for missing or damaged items must be reported within 48 hours of delivery confirmation.

5. Damaged, Incorrect, or Incomplete Orders
• Customers must provide: 
• Order number
• Photos of damaged packaging and product
• A clear description of the issue
• Claims submitted without documentation may be delayed or denied.
• Approved resolutions may include replacement, store credit, or refund at the sole discretion of Food By The Word LLC.

6. No Guarantees on Delivery Dates
• Food By The Word LLC does not guarantee delivery dates, including for gifts, events, holidays, or special occasions.
• Customers are encouraged to order well in advance during peak seasons.
• Delays caused by weather, labor disruptions, carrier backlogs, or regulatory issues are outside our control.

7. Cancellations & Order Modifications
• Orders may not be canceled or modified once processing has begun.
• Custom, bulk, or limited-run items are non-refundable once confirmed.
• Any approved cancellations prior to processing may be subject to administrative fees.

8. Force Majeure
Food By The Word LLC shall not be held liable for failure or delay in performance due to causes beyond reasonable control, including but not limited to:
• Carrier service disruptions
• Supply chain shortages
• Natural disasters
• Government actions
• Labor disputes

9. Limitation of Liability
• Food By The Word LLC’s liability is limited to the purchase price of the product.
• We are not responsible for indirect, incidental, or consequential damages.
• By purchasing, the Customer agrees that remedies are limited to those expressly stated herein.

10. Acceptance of Terms
By placing an order, the Customer acknowledges and agrees to:
• These Terms & Conditions in full
• The stated 10–14 business day fulfillment window
• Applicable shipping and handling charges
• The realities of third-party carrier performance

11. Governing Law
These Terms & Conditions shall be governed by and interpreted under the laws of the State of Indiana.
